By downloading, installing, or using any application developed by Sonal Udeshi ("Developer", "we", "us", or "our"), you ("User", "you") agree to be legally bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not download, install, or use the application.
By using the application, you represent and warrant that:
If you download an application through Apple's App Store, your use of that application is also subject to Apple's Licensed Application End User License Agreement ("Standard EULA"), unless a separate custom end user license agreement is presented to you in the App Store listing.
To the extent required by Apple, the Standard EULA applies to App Store downloads and will control in the event of any conflict with these Terms.
Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the application solely on devices you own or control, for your personal, non-commercial use.
This license does not include the right to sublicense, resell, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the application. Any breach of these restrictions will result in immediate termination of this license.
You agree that you will not:
The Developer reserves the right to modify, suspend, or discontinue the application or any feature thereof at any time, with or without notice, and without liability to you. We do not guarantee that the application will be available at all times, free from errors, or uninterrupted.
We may also impose limits on certain features or restrict access to parts or all of the application without notice or liability.
Sonal Udeshi is solely responsible for providing maintenance and support services for the application, as required under applicable law. Apple has no obligation whatsoever to provide any maintenance or support services with respect to the application.
The Developer makes no commitment to provide updates, fixes, or new features. Support, if offered, may be withdrawn at any time at the Developer's sole discretion.
Sonal Udeshi, not Apple, is responsible for addressing any claims by you or any third party relating to the application or your use of it, including but not limited to product liability claims, claims that the application fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. THE DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT.
The Developer does not warrant that the application will meet your requirements, that it will be error-free, secure, or uninterrupted, or that defects will be corrected. You assume all risk associated with the use of the application.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SONAL UDESHI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APPLICATION.
In no event shall the Developer's total cumulative liability to you for all claims arising out of or related to these Terms or the application exceed fifty US dollars ($50.00), regardless of the cause of action or the form in which the claim is brought.
You agree to indemnify, defend, and hold harmless Sonal Udeshi from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
Our applications offer a selection of features at no cost. Additional premium features are available through a monthly subscription (referred to as "Premium" or "Pro"). The Developer reserves the right to change, limit, or remove any free features at any time without prior notice.
Free features remain accessible without a subscription at all times, unless otherwise stated.
Premium access is offered as an auto-renewing monthly subscription purchased through Apple's App Store. By subscribing, you agree to the following:
All content within the application — including but not limited to text, graphics, logos, icons, audio, video, data compilations, software, and their selection and arrangement — is the exclusive property of Sonal Udeshi or its licensors and is protected by applicable intellectual property laws.
No part of the application may be reproduced, distributed, transmitted, displayed, published, or broadcast without the prior written permission of the Developer.
The application may provide access to third-party websites, content, or services. The Developer has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party services. Access to such services is entirely at your own risk. The Developer disclaims all liability arising from your use of third-party services.
The Developer reserves the right to terminate or suspend your access to the application immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the application ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive.
You may not use or otherwise export or re-export the application except as authorised by United States law and the laws of the jurisdiction in which the application was obtained. The application may not be exported or re-exported into any US-embargoed country or to anyone on the US Treasury Department's Specially Designated Nationals List or the US Department of Commerce Denied Persons List or Entity List.
To the extent required by Apple's Standard EULA, these Terms are governed by the laws of the State of California, excluding its conflict of law provisions. If you are a consumer based in the European Union, Switzerland, Norway, or Iceland, the laws of your country of residence apply to the extent required by local law.
For any disputes arising directly between you and Sonal Udeshi that are not governed by Apple's Standard EULA, the courts of Rajkot, Gujarat, India shall have exclusive jurisdiction, and such disputes shall be governed by the laws of India.
You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
The Developer's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be made in writing and signed by the Developer to be effective.
These Terms, together with the Privacy Policy and any other legal notices published by the Developer, constitute the entire agreement between you and Sonal Udeshi with respect to the application and supersede all prior agreements, understandings, and representations.
The Developer reserves the right to modify these Terms at any time. Changes take effect immediately upon posting. Your continued use of the application after any modification constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
